Forfeiture of commercial leases prohibited until 30 June 2020

Part of the Government’s initiatives to tackle the impact of coronavirus include help for commercial tenants.

Emergency legislation currently going through the parliamentary process includes a provision that:

Commercial tenants who are unable to pay rent due to the impact of COVID 19 will have protection from forfeiture of their leases until at least 30 June 2020

The Government and landlords are talking and will continue to talk with each other to find ways to help and support everyone through this time.

It is hoped the new measures will provide reassurance to businesses struggling with cashflow. It will ensure no commercial tenant is evicted over the next 3 months.

Landlords may of course not welcome this news when they are struggling to manage their own positions. However, it is envisaged landlords will be able to seek sensible arrangements with their own lenders given the effective freeze on repossessions over same period.
